Lawyer expelled from the community – shared login details

A lawyer shared her client’s social media login details.

Now she is being expelled from the Swedish Bar Association.

However, five members of the association wanted the woman to receive a warning and a fine of 250,000 kronor instead, writes Dagens Juridik.

According to the complaint to the disciplinary committee, the lawyer allegedly shared the login details for her client’s Instagram and Facebook accounts – despite him being under full restrictions. The person she shared the details with was the client’s mother, and this led to her deleting the accounts, writes Dagens Juridik.

The mother said that there were links to the accounts on Flashback, which meant that the son’s picture and the family’s name were spread.

The work was demanding

The lawyer herself states that she shared the login details, but also that her work was very demanding during this period. Furthermore, it meant that she “unfortunately did not give herself the customary, and so important, time for reflection and consideration”.

She also explains that the reason the mother asked for the information was because the situation for the family was very difficult. However, in retrospect, she understands that her actions have led to the complainant and relatives reacting.

Discriminating members

The Bar Association’s disciplinary committee believes that the lawyer’s actions have led to consequences in the investigation of a very serious crime. As a result, she is expelled from the Bar Association.

However, five members were arbitrary and considered that the woman should instead receive a warning and a fine of 250,000 kronor. According to them, the woman had not intentionally hindered the investigation.
